The legislation justifies the penalty under the government’s power to regulate commerce. Obama himself flatly denied that the penalty was a tax. However, for legal reasons, the Obama administration is beating a retreat on this key point. Randy Barnett points out that administration officials are now changing their tune. They are telling the New York Times that the individual insurance “requirement” and “penalty” are really an exercise of the congressional tax power. Unfortunately, we have many more such “surprises” to look forward to if Obamacare survives.
It’s funny how the political class is always wringing its hands about the potential for violence at Tea Party rallies, while 100% of the actual violence and intimidation that take place at political events is committed by union goons.
There is no free lunch– and the biggest price of all is paid by people who are unemployed because politicians cannot leave the economy alone to recover, as the American economy has repeatedly recovered faster when left alone than when politicians decided that they have to “do something.”

I think that ideology is partly endogenous. I do not think that it is an accident that an ideology of rational technocratic control grew up as America urbanized and as enormous scale economies emerged in the industries made possible by the internal combustion engine, the electric motor, radio, and television. I do not think it is an accident that the Progressive ideology will be challenged as the Internet starts to alter the economy and society, reducing the comparative advantage of mass production and mass media while increasing the comparative advantage of local autonomy and individual expression.
